Justice, can it restore societies decimated by war or by dictatorship? Since Nuremberg and afterwards through international criminal courts and truth and reconciliation commissions, a growing number of countries would like to think so.

Diplomatie du repentir, commissions Vérité, Tribunal pénal international, réparations, lois mémorielles : de l’Argentine à l’Afrique du Sud, en passant par l’ex-Yougoslavie et le Rwanda, l’usage public de l’histoire serait-il condamné à ne produire que des effets néfastes ? A un moment où se développent les invectives à l’adresse d’une justice internationale perçue comme inefficace ou trop désincarnée, et alors que nombre d’intellectuels (surtout français) ne cachent plus leur agacement face à la multiplication des déclarations de repentance, il devenait urgent de dresser un premier bilan critique des politiques de réconciliation mises en oeuvre depuis la fin de la guerre froide.
